Snippet Garden Terms of Service
The following terms and conditions ("Terms of Service") will govern your use of
all services located under the domain snippetgarden.com (The "Service").
BrainJocks has complete discretion to update and change these Terms of Service from
time to time, and to change the scope or features of Snippet Garden and the service
from time to time. Although BrainJocks will use reasonable efforts to notify you
of changes when commercially practical, we reserve the right to make such changes
without notice. If you continue to use the Service after any such changes, with
or without notice, you will be considered to have consented to them. You can always
review the most current Terms of Service via http://www.snippetgarden.com/Legal/TermsOfService.aspx.
The Service belongs to and is provided by BrainJocks fka. Catalyst Networks, Inc.
By using this Service, you are agreeing to be legally bound by the Terms of Service.
If at any time you are not willing to be bound by all of these Terms of Service,
then you must stop using the Service. If you violate any part of this Terms of Service,
your account will be terminated. You agree to use the Service at your own risk.

Copyright and Content Ownership
BrainJocks will claim no intellectual property rights on the Content you provide
to the Service. Your Credentials and Content remain yours. However,
any pages you set to share to accounts linked to your account (to be viewed publicly),
you are agreeing to allow others to share or view your Content. BrainJocks reserves
the right (but not obligation) to remove or refuse any Content at our discretion
that is available on the Service. It is not the obligation of BrainJocks to remove
Content or accounts that we determine to be pornographic, offensive, unlawful, threatening,
defamatory, obscene, or that violates any party's intellectual property. However,
we do have the right to remove such Content or accounts.
BrainJocks owns the Service as a whole, including all computer code, graphics, user
interfaces and audiovisual content used to provide the Service. All portions of
the service, computer code, the user interface and the graphic elements are all
copyrighted works of BrainJocks. Various other aspects of the Service may be protected
by intellectual property laws including trademark, copyright, patent and trade secrets.
BrainJocks uses third party services (including hosting) to provide the necessary
infrastructure to provide and run the Service.
Your Account
If you are 13 years or older, you may access this service. However, until you reach
the age of 18 years old (or the legal age to form a binding contract in the place
where you live, if that age is not 18), then your use of Service must be under the
supervision of your parent or guardian who has agreed to the Terms of Service. If
you do not qualify in at least one of these ways, then you may not use the Service.
BrainJocks can refuse registration of, or cancel an account at their discretion,
at any time.
Your account will be accessed though a user ID and password that you will create
(your "Credentials"). Your Credentials are solely for your personal use. You must
provide your legal full name, a valid email address, and any other information requested
in order to complete the signup process. You are responsible for maintaining the
confidentiality of your Credentials, and you are fully and solely responsible for
all activities that occur under your Credentials. It is up to you to take adequate
precautions with your Credentials, and to immediately notify BrainJocks of any unauthorized
use of your Credentials. Your Credentials may only be used by one person. A single
set of Credentials shared by multiple people is not permitted.
You are responsible for all Content posted and activity that occurs under your account
(even when Content is posted by others who have account linked to your account).
One person or legal entity may not maintain more than one free account. If you are
using a free account, you may not block ads.
Payment & Cancellation Terms
Free accounts do not require the entry of a credit card. In order to obtain use
of the paid account services, a valid credit card is required. Paid accounts with
a free trial period do require a valid credit card before free trial period begins.
If you sign up for a paid account and you don't cancel that account within the free
trial period specified, you will be billed monthly starting on the first day after
the trial period is complete. If you cancel prior to the processing of your first
invoice on the last day of the trial period, then you will not be charged.
An upgrade from a free trial one user plan to any paying plan will end your free
trial. You will be billed for the first month immediately upon upgrading. Any changes,
upgrade or downgrade, in pay plan will be charged against the credit card you provided
will be automatically charged the new rate on the next billing cycle. If you choose
to downgrade your Service, BrainJocks does not accept any liability to any loss
of content, features, or capacity of your Account.
This Service is billed in advance on a monthly basis and in non-refundable. No refunds
or credits will be issued for upgrade/downgrade changes or partial month usage of
services. Months used with an open account (neglect in following procedures to properly
cancel your account) will not receive refunds. No exceptions will be made.
Service fees are exclusive of taxes, levies, or duties imposed by any taxing authorities
and you will be responsible for all such payments of taxes, levies or duties with
the exception of United States (federal or state) taxes.
BrainJocks reserves the right at any time and from time to time to modify or discontinue,
temporarily or permanently, the Service (in part or in whole) with or without notice.
If prices are to change, including but certainly not limited to monthly subscription
plan fees, are subject to change with a 30 day notice from BrainJocks. Notice will
be given by communication in any combination of the following: email, posting to
the SnippetGarden site (www.snippetgarden.com) or the Service itself.
Proper cancellation of your Account is your sole responsibility. You may cancel
your account at any time by accessing your account though the site settings/account
link in the global navigation bar at the top of the screen. The cancellation link
must be used and you must receive a confirmation email to ensure your account has
been cancelled. When you cancel your account, it is effective immediately and you
will not be charged again. Upon cancellation of your account, all of your Content
will be immediately deleted from the Service. BrainJocks cannot recover any of your
Content after cancellation.
BrainJocks has the right at any time, under its' sole discretion, to suspend or
terminate your account, or refuse any and all use of the Service, current or future.
BrainJocks reserves the right to refuse service to anyone at any time.
General Terms
These terms remain in full force and effect while you use the Service.
You may not use the Service for any illegal or unauthorized purpose. You must not,
in the use of this Service, violate any laws in your jurisdiction (including but
not limited to copyright laws).
You will not steal, copy, duplicate, reproduce, sell or resell (or anything similar
to the aforementioned) to any portion of the Service.
The use of the Service is at your own risk. You understand that BrainJocks does
not warrant your specific needs met with this service. The Service is available
on a "as is" and "as available" basis.
